  北京市住房和城乡建设委员会关于优化建设工程招投标营商环境有关问题的通知

  各区住房城乡建设委,东城、西城住房城市建设委,经济技术开发区建发局,各有关单位:

  为贯彻落实《国务院办公厅关于开展工程建设项目审批制度改革试点的通知》(国办发〔2018〕33号)、《北京市工程建设项目审批制度改革试点实施方案》(京政办发〔2018〕36号)文件精神及本市有关优化营商环境的政策,市住房城乡建设委进一步优化本市建设工程招投标工作,现将有关事项通知如下:

  一、社会投资的房屋建筑工程,在确定施工单位、监理单位和建设工程货物供应商时,可自主决定发包方式,不再强制要求进行招投标。

  二、社会投资的房屋建筑工程,建设单位直接发包的,可直接与承包单位签订合同,不需要到建设行政主管部门办理直接发包手续。

  三、社会投资的房屋建筑工程,选择进入北京市公共资源交易建设工程分平台进行招标的,取消招标人自行招标条件备案、资格预审文件备案、招标文件备案和招投标情况书面报告备案,不再公布承包商信息。

  四、使用国有企事业单位资金,施工总承包单项合同额3000万元以下的房屋建筑工程,招标人自行招标条件备案、资格预审文件备案、招标文件备案和招投标情况书面报告备案全部简化为告知性备案。

  五、加强事中事后监管,重点对实行告知性备案或告知承诺制的事项进行检查,严肃查处违法违规行为。

  六、各区住房城乡建设委应当严格落实优化营商环境相关政策精神,并将项目信息及时推送至北京市公共资源交易建设工程分平台。

  七、本通知自发布之日起实施。

  Notice of Beijing Municipal Commission of Housing and Urban-Rural Development on Issues Regarding Optimization and Construction of Project Bidding Business Environment

Commissions of Housing and Urban-Rural Development of various districts, Commissions of Housing and Urban Development of Dongcheng and Xicheng districts, Construction and Development Bureau of Beijing Economic-Technological Development Area as well as related units:

  To implement the spirits of Notice of the General Office of the State Council on Launching the Pilot Program of the Reform of the Approval System for Construction Projects (Guo Ban Fa [2018] No. 33) and Implementation Plan of Beijing Municipality for the Pilot Program of the Reform of the Approval System for Construction Projects (Jing Zheng Ban Fa [2018] No. 36) as well as the policies of Beijing for optimizing the business environment, Beijing Municipal Commission of Housing and Urban-Rural Development further optimizes the bidding work for construction projects and notifies the related matters as follows:

  1. When determining the construction unit, supervision unit and construction goods supplier for any housing construction project of social investment, the construction unit may decide at its discretion the mode of contract issuing and the compulsory requirement of tendering and bidding no longer applies.

  2. In any housing construction project of social investment, if the construction unit adopts the direct contract awarding, it can directly sign the contract with the contractor unit, without handling procedures for direct contract awarding at administrative departments competent for construction.

  3. In any housing construction project of social investment, if the invitation for bids is conducted on the construction project sub-platform of Beijing Public Resources Trading Service Platform, the filing of terms of tender by the tenderee itself, the filing of prequalification documents, the filing of bidding documents and the filing of written reports on bidding conditions will be cancelled and the information of the contractor will not be disclosed.

  4. For housing construction projects that use the funds of state-owned enterprises and institutions and have a general contracting single contract amount below 30million yuan, the filing of terms of tender by the tenderee itself, the filing of prequalification documents, the filing of bidding documents and the filing of written reports on bidding conditions will be simplified into informative filing.

  5. Strengthen interim and ex-post supervision, focus on checking the matters involved in informative filing or informative commitment system, and seriously investigate and impose punishment on violations of laws and regulations.

  6. The commissions of housing and urban-rural development of various districts shall strictly implement the policy spirit for optimizing the business environment, and input the project information into the construction project sub-platform of Beijing Public Resources Trading Service Platform in a timely manner.

  7. This Notice will come into force as of the date of promulgation.
