原标题:labor contract与employment contract的区别 labor contract与employment contract,前者习惯译为“劳动合同”,后者习惯译为“雇佣合同”。二者极易混淆,都是以劳动换取收入的合同,在实践中很难将之正确区分开来。但二者有着本质的不同,劳动合同是劳动者与用人单位确立劳动关系,明确双方权利义务的协议。雇佣合同是受雇人向雇佣人提供劳务,雇佣人支付报酬的合同。还有一个概念,劳务合同,其有广义与狭义之分,广义的劳务合同是指一切与提供活劳动服务(即劳务)有关的协议,比如承包合同、运输合同等,而狭义的劳务合同等同于雇佣合同。以上内容仅针对我国,但是在英美,恰恰相反,employment contract是正式的“劳动合同”,而狭义上的劳务合同却是“contract of services”,不存在“labor contract”这一概念。综上: 1 英美很少提及这一概念,我国的“labor contract”等同于英美的“employment contract”。 2 An employment contract is a legally binding document that sets out the expectations, rights, and obligations that will govern the relationship between an employee and employer.
