labor contract与employment contract，前者习惯译为“劳动合同”，后者习惯译为“雇佣合同”。二者极易混淆，都是以劳动换取收入的合同，在实践中很难将之正确区分开来。但二者有着本质的不同，劳动合同是劳动者与用人单位确立劳动关系，明确双方权利义务的协议。雇佣合同是受雇人向雇佣人提供劳务，雇佣人支付报酬的合同。还有一个概念，劳务合同，其有广义与狭义之分，广义的劳务合同是指一切与提供活劳动服务（即劳务）有关的协议，比如承包合同、运输合同等，而狭义的劳务合同等同于雇佣合同。以上内容仅针对我国，但是在英美，恰恰相反，employment contract是正式的“劳动合同”，而狭义上的劳务合同却是“contract of services”,不存在“labor contract”这一概念。综上：
